Today a federal judge in Texas ruled that the CDC's national ban on evictions — which has been in place since September — is unconstitutional, siding with property managers who argued the ban is an overreach of federal power.
The ruling doesn't change anything at this point since the judge hasn't issued an injunction, but it brings up all sorts of issues when it comes to landlords and tenants, especially for mom-and-pop landlords who don't qualify for relief themselves.
Figuring out what consumers need in the pandemic has been a moving target for federal officials. Yesterday, the FHFAextended its moratoriums on single-family foreclosures and REO evictions until June 30, and extended forbearance for another three months, meaning borrowers can be in forbearance for up to 18 months. Which begs the question — at what point does a homeowner's "temporary" COVID hardship become a permanent condition? And how does that affect servicers?
